Strikes Commercial Debt Recovery process.
1. Initial Review & Instruction
We assess the debt, confirm details, review documentation and calculate interest where applicable.

2. Letter Before Action (LBA)
A formal notice is issued to the debtor, outlining the sum owed, deadline for payment and intention to take legal action if unresolved.

3. Negotiation & Resolution Attempts
Our team makes contact to encourage settlement and seek an amicable outcome that preserves business relationships where possible.

4. Escalation if Unpaid
If no payment is received, we advise on the most appropriate legal remedy – County Court Judgment, Statutory Demand or enforcement.

5. Enforcement / Insolvency Action
Where required, we can support escalation to High Court enforcement or insolvency proceedings to secure payment.

What Happens if Escalation is Needed?
If voluntary payment isn't made following the Letter Before Action, we may recommend escalating the matter through formal recovery routes. There are two primary legal pathways that can be used to apply pressure and secure a legally enforceable outcome. We will assess your case and advise which method is most appropriate based on the circumstances, value of the debt and the debtor’s position.
The options are:
1. County Court Judgment (CCJ)

A money claim is issued to obtain a Money Order

The order can be transferred to the High Court for enforcement via a Writ of Control

Once issued, our Enforcement Agents, overseen by an Authorised High Court Enforcement Officer, can enforce the judgment

CCJs are registered with the Registry Trust, impacting the debtor’s credit profile

2. Statutory Demand (Pre-Insolvency Action)

Thresholds: £750+ for company debt, £5,000+ for individuals
